Vivid Domains Privacy Policy
Vivid Domains considers your trust and privacy very important. Our Privacy Policy is described in the Privacy Notice below. By visiting any of the sites offered by Vivid Domains you are accepting the practices described in this Privacy Notice.
Collection of Information from our Clients.
In order to process your order, we need to know some standard information such as your name, e-mail address, mailing address, credit card number and telephone number. The quasi-governmental authority over domain names for .com, .net, org, .biz, .info, .us and .name top level domains, ICANN, (Internet Corporation for Assigned Names and Numbers) requires that we make available to the public your registrant information and the administrative and technical contact information via our Whois service. Our Whois service displays the minimum amount of information required in order to comply with ICANN requirements. It is our policy that all other information you submit is private and confidential. All information you provide is stored in a secure location, is accessible only by designated staff, and is used only for the purposes for which you provide the information. When you submit an order, your information is encrypted with secure server software to protect the information from unauthorized access.
Automatic Information.
We receive and store certain types of information whenever you interact with us. For example, like many Web sites, we use "cookies," and we obtain certain types of information when your Web browser accesses our sites. Examples of the information we collect and analyze include the Internet protocol (IP) address used to connect your computer to the Internet; computer and connection information such as browser type and version, operating system, and platform; the full Uniform Resource Locators (URL) click stream to, through, and from our Web site, including date and time. We use IP addresses to analyze trends, administer the site, track user's movement, and gather broad demographic information for aggregate use. Cookies are also used to control the flow of the ordering processes by maintaining the state of your online transactions.
No Computer Tracking of Identifiable Information.
Our computers do not track or collect personal information about our visitors. They do recognize the home server of visitors, but not e-mail addresses. For example, we can tell which Internet Service Provider our visitors use, but not the names, addresses or other information about our visitors that would allow us to identify the particular visitors to our sites. Our web sites track information about the visits to our web sites, for example, statistics that show the number of visitors to our sites, the requests we receive for particular files on our web sites, and what countries those requests come from. These aggregated statistics are used internally to provide better services and may also be provided to others, but the statistics contain no personal information and cannot be used to gather such information.
Bulk Access to data provided by our Whois service.
We are required to provide third parties with the ability to receive bulk access to certain elements of our Whois data. We are permitted to exclude your Whois data from bulk access if you request that your Whois data not be made available by bulk access. Accordingly we provide you with an option to "opt-out" of such bulk access each time you register domain names with us.
E-mail Updates.
We may occasionally notify you of new services and special offers via e-mail updates. If you would rather not receive any updates from us, please send a request to be removed from our e-mail update list to: support@vividdomains.com. We use the information we collect to direct important notices and information affecting your account or services, as well as to provide general information that may be of interest to you, including newsletters, surveys, contest and sweepstake announcements, and information about our service or product offerings or the offerings of our business affiliates. You may opt out of receiving information from us simply by notifying us of your desire in accordance with the opt-out instructions contained in any information message you receive from us. Note, however, that in order to fulfill our service obligations to you, we must continue sending you notices and other important information affecting your account or services.
With Whom We May Share Information.
When you register a domain name through us, we must disclose your domain name and its associated Name Servers and Internet Protocol ("IP") numbers to the Registry in order to make your chosen domain name a functional address on the Internet.
We may share certain information about you with those of our vendors who are responsible for handling your account or performing other necessary services that you require. Although we may share sensitive financial information (i.e., credit card numbers, banking information), security information (e.g., account passwords) and personal communications (e.g., personal e-mail messages or message board postings) with such vendors where necessary and appropriate, we will not share such information with other third parties, except in response to formal requests (e.g., subpoena or court order) made in connection with litigation or arbitration proceedings directly relating to a domain name registration or other services we provide.
As noted above, we make certain information about you available to the general public via our domain name registration database look-up and other services. These services give users access to such data on a query-by- query basis. Qualified persons may also access such data on a bulk basis provided they agree, among other things, not to use the data to enable or otherwise support the transmission of mass unsolicited commercial advertising or solicitations via email; or (ii) sell or redistribute the data to third parties. If you do not want your personal information disclosed on a bulk basis, you may send us an email at support@vividdomains.com. Include the words "remove bulk access" in the subject line of the e-mail and all the domain names for which you are the registrant in the body of the e-mail.
Additionally, we may share the information stored on that database, as well as other information that is not of a sensitive nature, with carefully selected business partners, including those who offer services that complement those provided by us or which may otherwise be of interest to you. If you do not want us to share information about you with our business partners, you may send us an e-mail at support@vividdomains.com. Include the words "remove domain" in the subject line of the e-mail and all the domain names for which you are the registrant in the body of the e-mail. Please note, however, that, consistent with the current rules and policies for the Domain Name System, information about you must remain available in the publicly accessible registration database.
Our Accountability To You.
By purchasing our services, you obtain the protections of, and consent to the data processing practices described in, this Privacy Notice. When you purchase our services, you also represent to us that you have provided notice to, and obtained consent from, any third party individuals whose personal data you supply to us with regard to: (i) the purposes for which such third party's personal data have been collected, (ii) the intended recipients or categories of recipients of the third party's personal data, (iii) which of the third party's data are obligatory and which data, if any, are voluntary, and (iv) how the third party can access and, if necessary, rectify the data held about them.
Conditions of Use, Notices, and Revisions.
If you choose to visit Vivid Domains, your visit and any dispute over privacy is subject to this Notice and our Terms and Conditions, including limitations on damages, arbitration of disputes, and application of the law of the state of Florida. If you have any concern about privacy at Vivid Domains, please send us a thorough description to support@vividdomains.com, and we will try to resolve it. Our business changes constantly. This Notice, our Service Agreement and the Terms and Conditions will change also, and use of information that we gather now is subject to the Privacy Notice in effect at the time of use. We may e-mail periodic reminders of our notices and conditions, unless you have instructed us not to, but you should check our Web site frequently to see recent changes.
